MAY LINDSTROM SKIN
LIVE CONSULTATION CONSENT AND RELEASE AGREEMENT
By scheduling or participating in a May Lindstrom Skin, LLC (“MLS”) live video consultation (“Consultation”), you agree to the following terms and conditions.
1. Nature of Consultation
The Consultation is designed to provide general product guidance, education, and information about MLS products and skincare rituals. It is not medical advice, diagnosis, or treatment. MLS and its representatives are not medical professionals, and no medical advice is provided. You should consult a qualified healthcare provider for any medical concerns.
2. Recording and AI Transcription Consent
Consultations may be recorded and transcribed using Zoom’s features or other similar video conferencing platforms. By participating, you consent to the recording, storage, and transcription of audio and video of your session. Recordings and transcripts will be stored on Zoom’s secure cloud platform or the secure platform of the applicable service provider and accessible only to MLS and you, the session participant. You may withdraw consent to recording prior to or at the beginning of the session by notifying the MLS consultant, in which case the session will not be recorded. If consent is withdrawn during the session, recording will cease immediately, but any recording made prior to withdrawal will be retained unless you request its deletion.
3. Data Use and Privacy
MLS may collect and process information shared during your Consultation, including your name, contact information, audio, video, transcript data, and any personal information you voluntarily disclose about your skin concerns or product preferences, for the following purposes:
- To provide your Consultation and follow-up materials;
- To improve MLS training and internal quality assurance (with your consent);
- To conduct anonymized research and product development (with your consent); and
- Any marketing use of your likeness, voice, or statements requires separate express written permission, which may be provided through the optional consent mechanism described in Section 4 below.
Your personal data will be processed in accordance with MLS’s Privacy Policy located at www.maylindstrom.com/policies/privacy-policy (as may be updated from time to time), consistent with applicable privacy laws including, if applicable, the California Consumer Privacy Act (CCPA/CPRA), the EU General Data Protection Regulation (GDPR), and UK Data Protection Act 2018. In the event of any conflict between this Agreement and the Privacy Policy, the terms of this Agreement shall control with respect to Consultation-related data processing. You have the right to access, correct, request deletion of, or request portability of your data by contacting care@maylindstrom.com. MLS will respond to such requests within the timeframes required by applicable law (45 days under CCPA, 30 days under GDPR). California residents have additional rights under the CCPA, including the right to opt-out of the sale of personal information and the right to non-discrimination for exercising privacy rights.
4. Optional Data Use Consents
The following consents are being given by you upon selecting “I Agree” or scheduling a Consultation. You may opt out of any of the following optional consents prior to your consultation by informing your MLS consultant at care@maylindstrom.com in advance in writing. If you do not opt out, you will be deemed to have consented to the uses described below.
- I consent to MLS using my recording and transcript for internal staff training.
- I consent to MLS using my de-identified session data for research and product development.
- I consent to MLS using my likeness, voice, image, or statements for marketing purposes, including but not limited to social media, website content, advertisements, and promotional materials.
You may also revoke any previously-given consent at any time by emailing care@maylindstrom.com. Upon revocation, MLS will cease the applicable use of your data, but revocation will not affect any uses made prior to the revocation or any anonymized data that cannot be re-identified.
5. Liability Release
You understand that MLS products are cosmetics and not medical treatments. You assume all responsibility for your participation and for your use of any recommended products. To the fullest extent permitted by law, you release MLS, its owners, officers, directors, employees, contractors, and agents from any and all claims, damages, losses, liabilities, and expenses arising from or related to your participation in the Consultation or your use of MLS products, including but not limited to allergic reactions or skin sensitivities, except for claims arising from MLS's gross negligence, willful misconduct, or violation of applicable consumer protection laws.
6. Governing Law
This Agreement is governed by the laws of the State of California, without regard to its conflicts of laws principles. Any disputes shall be resolved in Los Angeles County, California.
7. Electronic Consent
By selecting “I Agree", scheduling a Consultation, or participating in a Consultation, you acknowledge that you have read, understood, and agree to be bound by this Agreement. You consent to entering into this Agreement electronically in compliance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state laws. You further acknowledge that you have the right to receive a paper copy of this Agreement upon request by contacting care@maylindstrom.com.
This Agreement constitutes the entire agreement between you and MLS regarding the subject matter herein and supersedes all prior or contemporaneous understandings or agreements, whether written or oral. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect. MLS's failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
